Case Study 3
You are a high school principal and a senior at your school created a social media page to provide an outlet for her and her classmates to ridicule another student, Sandy. Several dozen at students at your school are given admission to the page by its designers. The students refer to Sandy using racial slurs and claim she has a sexually transmitted disease. The social media page was created at the student’s home using her personal computer. You suspend the student for 10 days for violating the student handbook policy that prohibits “harassment, bullying, and intimidation.” The student files a lawsuit. Based on Kowalski, what will the court decide? Would the Supreme Court’s decision in Mahanoy Sch. Dist. v. B.L., have any effect on the court’s ruling? Why or why not?
The student will research and find information on the articles discussed in the scenario above. The student will write a summary of the scenario, the two cases that are mentioned, and analyze school policy(s) that pertain to it and determine if they agree or disagree with the decision of the principal. In addition, the student will comment on at least two classmate’s posts.
Your initial post of a one page summary of the article is due by 11:59 p.m. on Thursday of module 2. Base your comments on the textbook, readings, legal cases and policies as well as your own experiences as an educator. Your replies are due by 11:59 p.m. on Sunday of the end of module 2.
