In the 1940’s there were approximately 200,000 adults under the supervision of the Department of Corrections (DOC) in the United States. This accounted for approximately 1% of the U.S. population, however in 2010, the number of individuals under the supervision of the Department of Corrections has climbed to a staggering 3% of the population. There are many theories of why there was a spike in the number of people under the care of the DOC. The reasons range from the population increase, firmer laws, more strict/lengthy sentences, better police work and more people, in general, taking on a life of crime.According to Graham (2021), a reporter for the Atlantic, there was not an increase in overall crime. Although the overall crime rate was at a consistent level, the amount of violence in crime was at an all-time high. This led to those convicted to be incarcerated for a longer amount of time. That being said, the statistics of incarcerated people would appear to rise, when it was actually the rate of release that has drastically went down. Beginning in 2020, and into 2021, there were approximately 21,500 murders, which was an increase of 30% (Graham 2021). Although there was that dramatic increase, there was an equal decrease in property crime. Another reason for the dramatic increase in the prison population in the last 70 years was President Reagan’s war on drugs.
In 1986, President Ronald Reagan signed the Anti-Drug Abuse Act (ADAA) of 1986. This law created mandatory minimum sentences for those in possession of crack cocaine. In doing this, the repercussions of power cocaine lesser. Besides the inherently racist law, the ADAA created an unbelievable rise in incarceration rates (Stephens, 2021). Crack cocaine is the cheaper of the two, therefor the people who were incarcerated due to the new law (most of which were minorities), were typically those who could not afford private council, nor could they make/post bail. Along with the upper-class not being targeted, they are also able to buy themselves out of trouble in one way or another.
Although the crime rates have not dramatically increased over the last 7 decades, the incarceration rate seems to climb. There is not one issue that is attributed to this, but most of them are flaws in the criminal justice system. From Reagan’s war on drugs, mandatory minimums and overall population increases, it is inevitable that the broken criminal justice system will fix itself in the aspect of it being designed to punish, not rehabilitate.
