Overview
After briefing the management team on employment law from the management team briefing on employment laws assignment, it is time to apply the knowledge to internal processes. there are many fundamental legal concerns surrounding recruiting and the overall hiring processes within organizations. a current review of the company’s hr policies and procedures centered on employment law reveals some possible opportunities to improve the overall recruitment and hiring process. specific opportunities exist in background checks, employment tests, and hiring and promotions. if not properly administered, these areas may cause employment law issues within the company.

WRITE A 6–8 PAGE PAPER IN WHICH YOU:
Briefly explain your overall understanding of conducting employee background checks. Why are they done? Why are they important? Be clear with your discussion.
Identify and discuss at least two types of background checks you believe most organizations conduct and explain how you will ensure the types you select are properly administered in the company.
List and describe at least five employee drug-testing procedures you would implement to comply with state drug-testing laws. How would you ensure adherence to the procedures?
Briefly discuss your understanding of bona fide occupational qualification (BFOQ), affirmative action preferences, and promotions. Then, identify at least three actions you would take to avoid employment law issues with these topics. Be specific
Additional Instructions: Week 6 Assignment Hints You’re still the HR Leader for your company. What are some types of employee background checks might you consider? You might not consider criminal background checks because of “ban the box”. However, you might need to check driving records, etc.
What federal employment laws govern employee background checks that you need to be mindful about? Pick 2 types of background checks and go into a detailed discussion of each one. Do some research about them and incorporate your references using APA format. (see the attached sample assignment). Perhaps you recommend social media checks instead of criminal background checks -why?
Make sure you CLEARLY identify 5 types of drug testing procedures and explain how you’d administer each one to avoid any legal problems. Not types of drug tests but types of PROCEDURES an organization must follow to ensure tests are dome legally.
BFOQ – research it -try to find CURRENT BFOQ issues. Is it still relevant in today’s workplace? Where and why? Affirmative action preferences – again consider today’s workplace – not the 1960’s. Where and when might it be relevant in today’s workplace?
Promotions – what legal issues might you have to consider regarding promotions? Identify and discuss 3 actions you’d take to avoid employment law issues with either BFOQ, affirmative action and/or promotion issues. You could have 3 issues with just promotions or can split up anyway you desire. Identify and discuss the specific employment laws involved (Title VII, ADA, etc). Be specific. Research – as you conduct your research avoid any research that is more than 5 years old. Focus on today’s environment.
