Overview: It is one thing to know the basic laws of tenancy and another to apply them. In this fictional scenario, you look at a tenant’s rights and a landlord’s rights regarding a leasing situation. In an area where property ownership is out of the realm of possibility for certain economic groups, leasing tends to become the norm. Knowing what laws apply can be useful both as a consumer and as a real estate sales or leasing agent.
The following Course Outcomes are assessed in this assignment: MT432-3: Recommend a landlord–tenant legal dispute resolution. GEL-1.02: Demonstrate college-level communications through the composition of original materials in Standard English.
Read the fictional scenario and respond to the checklist items in a case study analysis in a thorough manner.
Scenario: Susa Hansson leased an apartment in Austin, Texas, for $1,000 per month, signing a periodic tenancy agreement with the landlord. In December, the first month of occupancy, Susa found that the heat was sporadic. She did not inform the landlord because her neighbors had already put in a request to fix the heat in the building.

Then a month later she found the water pressure insufficient to take a shower. In the fourth month, there were all sorts of vermin running throughout the building. By May 30, she had had enough problems and sent an email to the landlord saying she was moving out the next day since she found the apartment uninhabitable.
She further stated that she wanted her 2-month deposit back and left her parents’ address for the landlord to send payment. Susa abandoned the apartment the next day after having sent the email. The landlord refused to return her deposit and is taking her to small claims court. In the interim, he rented her apartment starting July 1.
