The assailant attacks (A) and rips the purse handle. Fortunately, (A) took a self-defense class and used her knees and hands to strike the attacker, keeping her handbag and fleeing to safety.
Investigate assault, battery, and other offenses against people using the Internet or the Strayer databases.
Write a four- to six-page paper that includes the following:
1. Compare and contrast the fundamental similarities and differences between assault with a deadly weapon and felonious and aggravated battery crimes. To support your response, give one (1) example of each offense.
2. Determine whether the man’s acts should be classified as assault in the jurisdiction where the crime happened. Determine if the man’s actions should be punished as battery by the jurisdiction. Justify your answer.
3. Identify one (1) distinct fact pattern that would transform the situation from felonious and aggravated assault and/or battery to simple assault. Assert the truthfulness of your response.
Consider the following scenario modification. (A) is dragged into her car by a knife and forced to drive the suspect away from the mall, where they come into a police roadblock. Despite the police negotiator’s demand that she be allowed to exit the vehicle, (A) is not permitted to do so.
1. Discuss kidnapping as a crime. Next, discuss whether the proposed modification in Question 3 would allow the attacker to be convicted of kidnapping by the court. Support your response with a rationale.
2. Recognize the differences between hostage taking and kidnapping. Support or refute the idea that one of the two offenses is more serious. Justify your answer.
