Overview
In this paper, you will examine the commercial lease agreement that has been provided and respond to questions about the lease’s terms. The paper must be at least 1,200 words long and include at least three scholarly sources in addition to the textbook and resources for the course.
Instructions
Examine the Commercial Lease Agreement (Attached) document that has been provided. Answer the questions below in at least 200 words per answer (a total of at least 1,200 words), citing at least three scholarly sources other than the textbook with in-text citations, and including a References page. Following current APA formatting requirements, format the title page, body of work, page numbers, headers, and References page. While Question #6 specifically addresses a Biblical perspective, such concepts should underpin all of your responses.
Make a narrative out of your responses to the questions below. Use correctly formatted headers to separate each of the following.
1. How can you tell the difference between a “commercial” and a “residential” lease? What effect do the changes in use have on the lease terms? Should the law attempt to protect the commercial tenant’s interests over the commercial landlord’s interests under a commercial lease agreement? Why do you think that is?
2. Sections 5 and 6 of the lease place obligations on the business tenant to make repairs to the leased property as well as to make adjustments and improvements to the leased property. Should these obligations be legally enforced on the business landlord, or should they be imposed on the tenant through the lease? Give an explanation for your response.
3. What is the landlord’s responsibility to “mitigate” damages under Section 15’s default provisions? Is it reasonable to expect the landlord to mitigate? Explain.
4. Sections 2 and 19 explain the formation of the security deposit and the parties’ rights to it. Is it the landlord or the renter that benefits from these rights? Is that acceptable? Why do you think that is?
5. In lieu of litigation, Section 29 provides mediation followed by arbitration to resolve disagreements. What are the benefits and drawbacks of such a clause? What criteria should be used to choose mediators and arbitrators?
6. If you were a businessperson with a Biblical viewpoint, what changes would you make to this lease to make the terms more biblical?
