LEGAL MEMORANDUM ON LAW AND ETHICS
You will demonstrate mastery of the following competency in this project:
Identify the difference between legal and ethical issues in business scenarios.
Scenario
Hiking equipment and clothing are neatly arranged on a table.
Because of the legal troubles that their company is encountering, John and Ann Applewood have recruited you as a legal assistant. They want you to draft a legal memorandum to assist the company in moving forward.
Mountain Top View Inc. has a long and illustrious history.
John and Ann Applewood launched Mountain Top View Inc., a modest outdoor-equipment company, based on their love of the outdoors a few years ago. The company has grown so quickly in recent years that it is now a publicly traded company.
John and Ann have found it difficult to adjust to the corporate world. Technology utilization and functionality have been a key concern for the organization because it does a lot of business online. Steve, John and Ann’s new CIO, is in charge of the company’s website and technology. The financial part was also a problem, so John and Ann just hired Victor as their CFO to help them with that.
When owner John arrives in one morning, he learns from his CIO that the customer database information has been hacked. Customers who ordered things online were affected by this data breach. Customers’ names, addresses, and phone numbers were all stolen. John and Ann are aware that they should inform their consumers, but they are also concerned about the possibility for negative publicity as a result of the situation.
One afternoon, Steve learns about a pending confidential merger between Mountain Top View Inc. and a major outdoor retail chain. He tells Victor about the merger during lunch, knowing that the stock price would rise dramatically, and pushes him to buy shares before the news about the merger becomes public. The day before the merger, both Steve and Victor purchase 2,000 shares of company stock. The janitor overhears them talking about the idea and reports them to the authorities, accusing them of insider trading.
Mountain Top View Inc. has also been sued for damages on the grounds of carelessness and product responsibility. After rock climbing with Mountain Top View Inc. equipment, a customer was wounded and had to have his arm amputated. He alleges the line snapped, causing him to fall, and that his injuries were caused by defective equipment.
Directions
Legal Challenges: Because they are aware of their lack of legal understanding, John and Ann have requested that you start by presenting some basic information regarding the legal issues that the company is facing.
Describe the legal difficulties surrounding tort law and the method for dealing with tort law matters in court in order to enlighten business owners about the scope of the problems they are experiencing. Make sure to identify the appropriate law in your response and apply it to the facts offered in the scenario to determine probable outcomes.
Describe legal issues relating to criminal law, as well as the process for dealing with criminal law matters in court, in order to enlighten business owners about the breadth of the problems they are facing. Make sure to identify the appropriate law in your response and apply it to the facts offered in the scenario to determine probable outcomes.
Describe legal difficulties that firms should be aware of, with a focus on technology-related issues. Give clear examples of what occurred and how the problems could be addressed more effectively in the future.
Ethical Issues: Next, outline the ethical issues that arose in the scenario to alert John and Ann to issues that they should be aware of and address inside their firm.
Describe the ethical issues that the business is facing. Give clear examples of what occurred and how the problems could be addressed more effectively in the future. In your description, include the following:
What ethical difficulties arose in the workplace, and how did they differ from legal concerns?
What steps could the organization take to ensure that the data breach is not repeated and that customer information is better protected?
Identify potential gaps in the company’s ethical practices for future projects by discussing the benefits and limitations of ethical tests and theories.
Finally, John and Ann would like you to provide recommendations regarding business responsibility and evaluating firm ethics. Your suggestions will help them find best practices for moving their business ahead.
Recommend corporate social responsibility best practices that will aid the company’s future activities. Consider how the suggested methods could assist the company in avoiding future legal and ethical challenges.
Recommend an ethical theory that the corporation should consider adopting for future operations. Explain why the recommended theory is a good approach for the company in your recommendation. As the company progresses, discuss the specific ramifications of technological advancement.
