Scenario of Business Management Liability
A fictional corporation, Widget’s, Inc., has a thriving lawncare operation. Two full-time employees have worked for the company for the past five years. All staff have been taught on how to use the lawn equipment and have signed a waiver-of-responsibility document that limits the company’s liability. Brian, the owner, assured his employees that they would be protected if they were injured.
Lori, one of the workers, was mowing the yard. Lori was riding a three-year-old Ferrari 2000 mower that was in good functioning order. “Replace the sandpaper liner for traction every three years owing to regular wear and tear,” said a caution label on the mower’s step-up. Every three years, it was replaced. Lori stepped off the rider, slid due to the grass’s dampness, and cut her pinky toe on the mower blade.
When she collapsed to the ground, the mower continued through the grass, cutting and mulching a neighbor’s prize roses on its own. Peta, the next-door neighbor, was preparing for a rose competition with a $10,000 grand prize.
Answer the following questions in a 2-3 page paper. Remember to identify and explain the legislation before justifying your responses to the scenario’s questions:
Is the waiver of liability legal under contract law, and do Brian’s verbal promises constitute part of the contract? Why do you think that is?
Is there a product liability lawsuit Peta can bring against Ferrari, the mower manufacturer, for a design defect, manufacturing defect, or failure-to-warn problem?
Is Lori entitled to compensation for her injuries, such as pain and suffering or worker’s compensation?
