Discrepancies in the Application of the Bill of Rights Discussion
I’m working on a social science discussion question and need guidance to help me learn.
The noted historian Gordon Wood observed that our Bill of Rights is actually directed against ourselves, we the very people who are the source of sovereignty in the United States. In other words, we must protect our individual rights against a majority of our fellow Americans acting through the democratic process. An example of this is the Supreme Court upholding the individual right to burn the U.S. flag even though the vast majority of Americans would probably wish to see this as a crime. Do you agree with Professor Wood’s observation?
