Consider the case below:
John Mathews caused an accident while driving while inebriated. In the accident, an elderly couple was gravely hurt. After the incident, the couple spent several weeks in the hospital and a year in physical therapy. John, on the other hand, had only suffered minor injuries.
John has a history of driving when inebriated. He attempted to overcome his drinking by joining alcoholic anonymous groups, but this proved futile. He returned to drinking after leaving the gang. He was previously involved in drunken driving incidents and was sentenced to probation for causing these accidents and injuring others.
What would be a reasonable penalty for John in terms of criminal justice, and why? In this matter, be objective and examine the rights of the elderly victims.
Conduct study to determine the rates of recidivism for drunk driving. Determine how many individuals are murdered each year as a result of drinking and driving. Are the current laws effective, or do they need to be changed? What legislative changes would you propose?
In these types of incidents, what are the financial and psychological consequences for the victims? What are the financial and psychological consequences for the victims’ families?
Through the investigation of the case scenario, discuss significant concerns in objectivity. Should the victims in this situation be evaluated by a victimologist with a modest history of drug or alcohol abuse? Why? Provide instances or incidents from your own life to back up your argument.
