Background Scenario: Several trees fell on Elizabeth Sampson’s porch during a recent storm, causing damage to the porch and its roof. Ms. Sampson claimed the trees belonged to one of Nelson Insurance’s clients, so Carl Anderson, a claims field agent, evaluated the damage. The trees were on Ms.side Sampson’s of the lot line, Mr. Anderson discovered. Ms. Sampson challenged Mr. Anderson’s findings and filed a claim with Mee Vue, the field claims manager. She looked over Ms. Sampson’s allegation and sent her the message below.

I have conducted a review of this topic as you requested. Sorry, but I agree with our representative’s opinion that the claim is not our responsibility. Carl Anderson, a field claims agent, did a thorough examination into your claim, as you are aware. Because the trees that fell were his, you stated that our insured, Mr. Conrad Dodge, is responsible for the expense of restoring the porch roof, dented paneling, and damaged screens. Nelson Insurance has obtained a copy of the most recent survey of the properties, which I have attached.My investigation into this case led me to the same conclusion as Mr. Anderson’s.
Unfortunately, we are unable to honor your claim because the current survey of your and Mr. Dodge’s properties plainly demonstrates that the trees are yours. While I appreciate your displeasure, if you check at the survey, you can clearly tell that these are your trees. As a result, Nelson Insurance has determined that your claim is without legal standing, and our insured is not liable in any way to you.
