The ED physician calls to arrange an EMTALA-qualified transfer from his hospital to yours, but the ENT physician on call at your hospital refuses, claiming that the patient does not require a higher level of treatment.
When you phone your ENT on call, he admits he’s had three glasses of wine and won’t be available for another six hours. You provide him the record that Health Hospital B would send with the patient electronically. The ENT doctor says the ear appears to be recoverable and could be sutured in any emergency room. The ED physician at Health Hospital B is really concerned about an EMTALA breach.
Is it a violation of EMTALA if you decide to refuse the patient? Explain.
